Constitution
This Constitution applies to all citizens and tourists of ArtRemains during the entire duration of their stay. Moreover, as citizens or tourists you expressly agree to accept full responsibility for any and all possible risk incurred by your decision to visit or inhabit the country of ArtRemains.
Citizens
Rights
(a) To express themselves.
(b) To nominate and elect Leaders.
(c) To determine the quantity of Leaders.
(d) To publicly criticize the laws, other citizens, Leaders, and the founder.
(e) To block any citizens that they feel are harming them.
(f) To customize their mature content filter to match their sensibilities.
(g) To customize their language filter to match their sensibilities.
(h) To receive one public warning per law broken.
(i) To request a public trial if incarcerated.
(j) To maintain complete rights over all uploaded content.
(k) To maintain sole responsibility for all uploaded content.
(l) To have their privacy protected as per the ArtRemains Privacy Policy.
Limits
(a) Are not allowed to upload any type of art in which any individual’s or animal’s freedom was infringed in the artistic process.
(b) Are not allowed to upload any type of art that is illegal in the United States.
(c) Are not allowed to upload other people’s art without their express written consent.
(d) Are not allowed to use other citizens’ art without their express written consent.
(e) Are not allowed to be under the age of 13.
(f) Are not allowed to significantly digress from the Mature Content Rating Guideline.
(g) Are not allowed to create more than one account.
(h) Are not allowed to represent anyone other than themselves.
(i) Are not allowed to spam.
(j) Are not allowed to harm ArtRemains.
(k) Are not allowed to sue ArtRemains.
(m) Are not allowed to Cyber-bully.
Tourists
Rights
(a) To visit ArtRemains.
Limits
(a) Are not allowed to be under the age of 13.
(b) Are not allowed to sue ArtRemains.
(c) Are not allowed to use citizen’s art without their express written consent.
(d) Are not allowed to view Mature Content Levels 5 to 10.
Leaders
Election Process
(a) Citizens are not allowed to nominate themselves.
(b) Nomination will be from the first of the month to the day before the last week of the month.
(c) Voting will take place the last week of the month.
(d) On the first of the month messages will be sent to the citizens with the highest votes asking them if they wish to be Leaders.
(e) There will be one Leader elected for N amount of citizens where N is decided by citizen vote.
Responsibilities
(a) Uphold the Constitution.
(b) Be responsive in a timely manner to citizen concerns.
(c) Browse recently uploaded works of art, blogs, forum threads, and avatars in order to correct Mature Content Level rating abuse.
(d) Provide one public warning per broken law.
(e) Incarcerate citizens who break a specific law despite having received one public warning not to break that specific law again.
(f) Hold public trials for incarcerated citizens who request them.
(g) Respond to jury summons in a timely manner.
(h) Look over all available evidence before submitting a verdict.
(i) Conduct Leader only voting to determine whether or not a work of art violates the Constitution.
(j) Manage all content within the Help section.
(k) Be transparent and accountable in all actions associated with this position
Limits
(a) Are not allowed to lock forum threads.
(b) Are not able to individually remove works of art.
(c) Are not allowed to accept bribes or favors.
(d) Are not allowed to abuse their power in any way.
Compensation
(a) Will receive a month or additional month of tax-payer status.
The Founder
Responsibilities
(a) Publish monthly financial statements.
(b) Invest at least 40% of profits back into ArtRemains.
(c) Donate 10% of profits to a charity selected by the citizens.
(d) Be accountable and transparent in all actions regarding ArtRemains.
(e) Be responsive in a timely manner to Leaders' concerns.
(f) Include citizens as much as possible in the ArtRemains decision making process.
(g) Never allow the majority to tyrannize the minority or vice versa.
Rights
(a) To have the final say in suggestion implementation.
(b) To not be held liable or responsible for content uploaded by citizens.
(c) To not be held liable for system errors.
(d) To modify the Constitution at any time.
Limits
(a) Will never incarcerate citizens.
(b) Will never remove any works of art.
(c) Will never lock forum threads.
(d) Will never privately try to influence the decisions of Leaders.
(e) Will never put profits ahead of citizens’ freedom or protection.
(f) Will never violate the ArtRemains Privacy Policy.
Compensation
(a) Will receive no more than 50% of the profits.
The Courts
Prosecutor Selection
(a) The prosecutor will be the Leader who incarcerated that citizen.
Prosecutor Responsibilities
(a) Create a Court Forum case/thread if a citizen they incarcerated requests a public trial.
(b) Provide well organized factual evidence that will help the jury decide whether or not the defendant violated the Constitution.
Defendant Rights
(a) The provide any evidence that supports their defense.
Public Rights
(a) Will have a separate section within the case/thread to comment.
Public Responsibility
(a) To provide any objective evidence that will assist the jury in making the fairest decision.
Jury Selection
(a) When a case is created 24 randomly selected leaders will be sent messages requesting their participation.
(b) The first 12 leaders to accept will be assigned to that case.
Jury Responsibility
(a) Objectively look at all the evidence and analyze whether the law was at fault for being unclear or the citizen was at fault for deliberately breaking the law.
(b) Vote for how many days (from 0 to 21) the citizen should be incarcerated for, the average of which will be the verdict.
Groups
Rights
(a) To create any rules that do not conflict with this Constitution
(b) To deny membership to any citizen.
